We respond to valid copyright notices and will remove or disable access to allegedly infringing content when appropriate.

4. Our Response Process
4.1 Timeline
Upon receiving a valid DMCA notice, we will:
- Acknowledge receipt within 1-2 business days
- Review the notice for completeness and validity (2-5 business days)
- Remove or disable access to the allegedly infringing content (if valid)
- Notify the content provider of the takedown (if applicable)
4.2 What We Will Do
If we determine your notice is valid, we will:
- Remove the link or stream from our platform
- Prevent future re-addition of the content (if possible)
- Document the takedown for our records
- Notify any affected users (if applicable)
4.3 Invalid Notices
If your notice is incomplete or invalid, we will:
- Contact you to request missing information
- Not take action until the notice is complete
- Inform you of deficiencies in your submission
5. Counter-Notification Process
5.1 If Your Content Was Removed
If you believe your content was removed in error or is not infringing, you may file a DMCA counter-notification. Your counter-notice must include:
- Your contact information (name, address, phone, email)
- Identification of removed content and its prior location
- Statement under penalty of perjury that you have a good faith belief the content was removed by mistake or misidentification
- Consent to jurisdiction of Federal District Court in your area
- Agreement to accept service of process from the party who filed the takedown notice
- Physical or electronic signature
5.2 Counter-Notification Process
Upon receiving a valid counter-notice:
- We will forward it to the party who filed the original takedown notice
- We will restore the content within 10-14 business days unless:
- The copyright owner files a court action seeking an injunction
- We receive evidence that such action has been filed
6. Repeat Infringer Policy
We have adopted and implemented a policy for terminating users who are repeat infringers. Users who repeatedly post or link to infringing content will:
- Receive warnings for first-time violations
- Face temporary suspension for second violations
- Have their accounts permanently terminated for repeat violations
We maintain records of takedown notices and track repeat offenders.
7. Misrepresentation
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents:
- That content is infringing, or
- That content was removed or disabled by mistake
shall be liable for damages, including costs and attorney fees, incurred by the alleged infringer, copyright owner, or service provider.
Please ensure all statements in your DMCA notice or counter-notice are truthful and accurate. False claims can result in significant legal consequences.
8. Limitations and Disclaimers
8.1 Third-Party Content
Open TV Streams does not control third-party content accessible through our service. We:
- Cannot guarantee removal of content from external servers
- Cannot prevent content from being re-uploaded by third parties
- Are not responsible for copyright compliance by external broadcasters
- May only remove links, not the underlying content
8.2 Geographic Considerations
Content that is infringing in one jurisdiction may be legal in another. We consider:
- The geographic location of the copyright owner
- Where the content is hosted
- International copyright treaties and agreements
